PMEG Gas

Any party wishing to supply natural gas to end customers (eligible customers) must hold a supply license issued by RAE in accordance with the natural gas license Regulation. This license is not required: (a) for the import and export of natural gas; (b) for the supply of natural gas to suppliers; (c) for the resale of natural gas to eligible customers;  and (d) for the sale of natural gas to gas stations. Even if the shipper does not wish to apply for the supply license, it still has to register with RAE as a user. The process and data required for the registration are almost the same as for the supply license (for example a business plan is also needed). Furthermore, it will have to sign with the TSO corresponding agreements for use of the system and the LNG terminal. Separate agreements and applications will be needed to book (reserve) capacity.

The estimations to be provided as per par. 1 are not binding for Transmission Users or for DESFA. DESFA is responsible for providing access to this data to RAE.

Comments 1. DESFA shall submit to RAE an annual gas balancing plan for the next year, which shall be approved by RAE (its amendments as well) and published at DESFA’s responsibility. 2. Every day that DESFA injects a natural gas quantity into the NNGTS as a result of balancing actions, it shall calculate the daily usage cost of the NNGS for gas balancing (“Daily NNGS Usage Cost”), in accordance with the provisions of article 48 of the NNGS. The Daily NNGS Usage Cost for each day shall be accounted in the balancing settlement account at the end of the month in which the day belongs. 3. The daily imbalance position of a Transmission User (“DIP”) is calculated for each day in accordance with the daily delivery/reception of the Transmission User and the formula provided in article 50 of the NNGS Code. The settlement of imbalances is conducted by DESFA in accordance with the provisions of articles 52-56 of the NNGS Code.

Comments Natural gas consumers whose facilities are directly connected to the NNGTS and the operators of the distribution networks, shall provide DESFA with their best possible estimations regarding the maximum daily quantity and the annual quantity of natural gas required for their needs. Legal basis 1. In accordance with article 101 of the NNGS Code and article 68 par. 2(ib) of the Energy Law, DESFA is responsible for the development and administration of the NNGS Electronic Information System. DESFA provides Transmission Users, the connected system operators or any other natural person or legal entity with legal interest, with access to the Electronic Information System, without any discrimination. For this purpose, DESFA publishes the specific terms and conditions for access to the Electronic Information System, which does not require payment of any amount. 2. The Administrator may at its sole discretion modify the Electronic Information System, provided that a relevant notification to RAE has taken place at least two (2) months prior to the modification. DESFA shall inform Transmission Users regarding all modifications to the Electronic Information System and before the implementation of such modification starts. 3. DESFA is obliged to provide to RAE access to the Electronic Information System and to any information regarding its operation thereof.

Legal basis According to articles 63 et seq. of the NNGS Code, DESFA has developed a crisis management unit (“CMU”), which is responsible for detecting, announcing and evaluating a crisis (i.e. any event which affects or may affect the smooth operation of the Greek natural gas market and/or its safe supply, as defined in EU Regulation 1938/2017, and impedes or may impede the regular implementation of the obligations and the exercise of the rights of   Transmission Users and DESFA) as well as for its prompt resolution in accordance with the provisions of the emergency plan. The CMU prepares and monitors the supply and demand balance of the NNGS. To this end, it collects and evaluates information and data that shall be provided by Transmission Users and operators of the upstream systems. The supply and demand balance is compiled over a seven (7) day period and is continuously updated by the CMU, taking into account the available data and measures taken. Communication between DESFA and the involved parties regarding any relevant to the crisis matter, is carried out via their authorised representatives, according to the provisions of the emergency plan.

Legal basis Pursuant to articles 104 and 105 of the NNGS Code regarding force majeure events, any person invoking such an event is obliged to: (i) notify immediately the other contracting party or any other person affected by it, by a registered letter (with receipt of delivery) or by any other expedient means, with regards to the event that constitutes the force majeure event, as well as any additional information regarding the estimated duration of the event and the actions which, according to its opinion, are necessary so as to address such event; (ii) notify the other contracting party or any other person affected by it with respect to the actions taken to address the incident that caused the force majeure event, with a view to its resolution, and the estimated duration of such event; (iii) secure the access of the abovementioned persons or their representatives at the site where the force majeure event occurred, in order to conduct inspections. In this case, the person requesting the inspection is responsible for reimbursing the person claiming force majeure for any expense incurred by the latter due to such inspection; and (v) draft within ten (10) business days from the resolution of the force majeure a report concerning the force majeure event, the action taken in order to address the issue as well as the consequences thereof, and submit it to the other contracting party or any other person affected by the event.
